1. About these Terms

These Terms and Conditions (“Terms”) apply to the purchase, registration for and use of products and services provided by Aly Khairuddin Ltd, trading as The Menopause Mind (“we”, “us”, “our”).

Our products and services may include, but are not limited to, digital products, courses, programmes, coaching, consultations, webinars, workshops, online events, educational resources and other related services.

By purchasing, registering for or accessing our products or services, you agree to these Terms.

2. Educational and health disclaimer

Our content and services are provided for educational and informational purposes.

This includes, but is not limited to, courses, programmes, webinars, workshops, videos, PDFs, downloads, emails, coaching and calls.

Our content and services are not:

Medical advice, diagnosis or treatment

A substitute for advice from your GP, consultant, physiotherapist, registered dietitian or other qualified healthcare professional

Psychotherapy, counselling or mental health treatment

You should consult an appropriate healthcare professional before acting on information provided by us, particularly if you have or suspect you have a medical condition, are taking medication, have an injury, are pregnant or postnatal, or have symptoms requiring clinical assessment.

3. Exercise and physical activity

Some of our products and services may include exercise, movement, Pilates, strength training, mobility or other physical activity.

Participation is voluntary and you are responsible for determining whether an activity is appropriate for you.

You are responsible for:

Ensuring that you are medically and physically able to participate

Using appropriate equipment, loads and resistance

Following instructions carefully

Exercising in a safe environment

Stopping if you experience pain, dizziness, shortness of breath or other concerning symptoms

Seeking appropriate medical advice where necessary

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.

4. Webinars, workshops and online events

We may provide free or paid webinars, workshops and other online events.

Unless otherwise stated:

Registration provides access to the specific event for which you registered.

Access details will normally be provided by email.

We may change the date, time, format or content of an event where reasonably necessary.

If we cancel a paid event and cannot provide a suitable alternative, we will provide an appropriate refund in accordance with your statutory rights.

We are not responsible for technical problems caused by your internet connection, device or third-party platforms such as Zoom.

Recordings

Some webinars, workshops and online events may be recorded.

Where an event is recorded, we will tell you before or when you join the event.

If you participate using your camera, microphone, chat or Q&A functions, your image, voice, name, questions or comments may be captured in the recording.

You can protect your privacy by keeping your camera and microphone turned off and avoiding sharing personal information during the session.

Recordings will be handled in accordance with our Privacy Policy. The ICO recommends telling attendees in advance about recording, its purpose and how recordings will be used.

5. Products, programmes and services

Details of each product or service, including its content, price, duration, access arrangements and any specific terms, will be provided at the time of purchase or registration.

We will provide products and services substantially as described at the time of purchase.

We may make reasonable changes to content, materials, schedules or delivery where necessary to improve or maintain the service.

Nothing in these Terms affects your statutory consumer rights, including your rights in relation to services that are not provided with reasonable care and skill or digital content that does not conform to the contract.

6. Pricing and payment

Prices are shown in GBP (£) unless otherwise stated.

The price payable will be the price shown at the time you place your order.

Payment must be made using the payment method offered at checkout.

Where a payment plan is offered, you agree to make each payment when due.

7. Digital products and access

Where you purchase a digital product, access instructions will normally be provided by email and/or through the relevant online platform.

You are responsible for providing an accurate email address and checking your inbox, including your spam or junk folders.

Unless otherwise stated at the time of purchase, access will be provided for the period stated on the relevant product or programme page.

We may update, improve or replace content during your access period, provided that the product or service remains substantially as described.

Immediate access to digital content

Where you request immediate access to digital content, you may be asked at checkout to expressly agree that access begins immediately and acknowledge that, once supply of the digital content begins, you may lose your statutory 14-day cancellation right.

This consent and acknowledgement will be obtained separately where required by law.

8. Cancellations and refunds

Your statutory consumer rights are not affected by these Terms.

Where a particular product or service has its own cancellation or refund policy, that policy will be clearly stated before purchase.

8.1 Our voluntary refund or money-back guarantees

Where we offer a money-back guarantee or other refund policy in addition to your statutory rights, the specific conditions of that guarantee will be stated on the relevant product or service page or at checkout.

8.2 Technical problems

If you experience a genuine technical problem accessing a digital product or service, please contact us as soon as possible.

We will make reasonable efforts to resolve the issue.

Where we cannot reasonably resolve an access problem, we will consider an appropriate alternative remedy or refund, taking into account your statutory rights.

9. Coaching and consultations

Where a product or service includes a 1:1 coaching session or consultation:

The duration will be stated at the time of purchase.

You are responsible for booking your session using the booking instructions provided.

Sessions should normally be rescheduled with at least 24 hours' notice.

Missed appointments or cancellations with less than 24 hours' notice may be treated as a used session, unless we agree otherwise.

Any specific cancellation or refund terms applying to a particular programme will be stated at the time of purchase.

Coaching and consultations are educational and supportive in nature and are not medical treatment, psychotherapy, physiotherapy or a substitute for appropriate clinical care.

10. Results and outcomes

We do not guarantee any particular result or outcome from our products or services.

Individual results will vary depending on a range of factors, including personal circumstances, health, behaviour, consistency and factors outside our control.

Any examples, testimonials or experiences shared by us are illustrative and should not be understood as a guarantee of what you will achieve.

11. Intellectual property

All materials provided by us, including written content, videos, audio, PDFs, presentations, workbooks, frameworks, methods, graphics, recordings and other resources, are owned by us or our licensors and are protected by intellectual property laws.

Unless we give you written permission, you may use these materials for your own personal, non-commercial use only.

You must not:

Copy, reproduce or distribute our materials

Share, sell or commercially exploit our materials

Upload our materials to another website, platform or AI system

Record or republish our sessions or content

Share your login details or allow another person to access your purchased content

Use our materials to create or deliver a competing commercial product or service

We may suspend or terminate access where you materially breach this section, subject to your statutory rights.

12. Acceptable use

You agree not to:

Use our platforms or services in a way that disrupts their operation or security

Attempt to gain unauthorised access to our systems, content or accounts

Harass, abuse, threaten or intimidate us, our team, guests or other participants

Use our services for unlawful purposes

Share private or confidential information about other participants without their permission

13. Privacy and personal information

We collect and use personal information in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and protect personal information, including information provided when registering for or participating in webinars, programmes, coaching and other services.

14. Our liability

We will provide our services with reasonable care and skill as required by law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

Subject to the above, we will not be responsible for indirect or consequential losses that are not reasonably foreseeable.

Where legally permitted, our total liability arising from a particular paid product or service will be limited to the amount you paid for that product or service.

15. If we need to change or cancel a service

We may occasionally need to change, postpone or cancel a webinar, workshop, programme session, consultation or other service because of circumstances such as illness, technical problems, operational issues or circumstances outside our reasonable control.

Where reasonably possible, we will provide advance notice and offer an alternative date or reasonable alternative.

If we cancel a paid service and cannot provide a suitable alternative, you will be entitled to an appropriate refund in accordance with your statutory rights.

17. Changes to these Terms

We may update these Terms from time to time.

The version of the Terms that applies to your purchase or registration will normally be the version in force at the time you entered into the relevant contract.

18. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you will also benefit from any mandatory protections provided by the law of the country in which you live.

Nothing in these Terms affects your statutory consumer rights.
